La Rioja rushes the Court and once again requests the total suspension of Milei’s DNU

The governor of the province, Ricardo Quintela, had asked at the end of December 2023 to declare the unconstitutionality of the president’s mega DNU Javier Milei, which came into effect this Friday. He did it with the sponsorship of the former judge of the court, Eugenio Zaffaroni.

At that time, the government of La Rioja asked the highest court to declare the “manifest unconstitutionality” of DNU 70/2023 of economic deregulation, which dictates a precautionary measure that immediately suspends its application and assumes “original jurisdiction” to hear the matter.

He did so through a “declaratory action of certainty” presented by Governor Quintela, with the sponsorship as lawyers of the former Minister of the Court Raúl Zaffaroni and Raúl Ferreyra, according to the document to which he had access Ambit.

In the “declarative action of certainty” requested that “the nullity be declared absolute and irremediable of decree n°70/2023 because it is manifestly contrary to the Constitution” and that immediately “a precautionary measure be issued that provides for the total suspension of the effects.”

The Court is also asked to order the Executive Branch “not apply any of its provisions until the final resolution of this case”.

The original jurisdiction of the highest court is justified by the fact that a province suing the national government is a party to the case.

“It has been defined that the cases that arise between a province and the federal State, in all types of matters, also correspond to the original instance,” the lawyers argued.

Javier Milei’s DNU: the Bicameral Commission starts this Thursday

The Bicameral Commission that will treat Decree of Necessity and Urgency (DNU) 70/2023 will meet this Thursday at the National Congress to begin discussing the reform proposed from the Executive power.

The first meeting of the parliamentary body will take place after the Chamber of Deputies confirmed the 8 deputies this Monday. It will be made up of 3 deputies from Unión por la Patria (UXP), 2 from La Libertad Avanza (LLA), 1 from the PRO, 1 from We Make the Federal Coalition (HCF) and 1 from the Radical Civic Union (UCR).

The designated deputies are: Ana Carolina Gaillard, Vanesa Siley and Ramiro Gutiérrez from UXP, Lisandro Almirón and Oscar Zago from LLA; Hernan Lombardi of the PRO; Nicolas Massot of HCF and Francisco Monti from the UCR.
